GENERAL TERMS AND CONDITIONS OF SALES

Every purchase done on the website www.noliju.com is submitted in advance to the knowledge and the acceptance of this general terms and conditions of sales.
Item : products of all nature offered for sale (e-commerce service) on the Website.
Customer : natural person who is not a trader, that is doing the order and having a full legal capacity.
Order : Purchase agreement of all items selected by the customer via the Website e-commerce service.
Website published by Noliju and accessible through www.noliju.com

  1. OBJECT

The purpose of those general terms and conditions of sales is to define the conditions in which the products are commercialized by Anyoine to the customer. They rule the different steps of the sale : from the order placement by the client to the product delivery at the client address.

  1. PREAMBLE

Those general terms and conditions of sales (“GTCS” below) apply exclusively between any client and the society Anyoine S.A.S, headquarter at CEEI, 61-63 Avenue Simone Veil, 06200 Nice, registered in the Nice Trade and Companies Register under the number 817 526 379.
The GTCS are applicable without restriction nor reserve at all the items offered on sale on the website.
Any order on the website is conditioned by the consulting and the acceptance unreserved from the client of the GTCS and the rate applicable.

The validation of an order following the order procedure proposed on the website implies acceptance of these Terms. These Terms prevail over any other document.

Selling items on the site is exclusively for retail and individuals.

The website cannot be used by customers professional sellers, alone or together, whatever the way of selling their products. The customer acknowledges and agrees therefore that the items can only be purchased in quantities corresponding to the average needs of a consumer, and as compared to the number of items ordered in one order as the number of individual orders respects the usual amount of an average consumer for the same product. Anyoine has the right to refuse orders that have been clearly validated by a professional Seller.

  1. PRODUCTS

Products sold by Anyoine are those which are visible on the Website the day of the consultation by the customer. Each product will have a description sheet that will contain the photography, the price, the available sizes, the composition and any particular feature. Minor differences can exist between a product and its photography because of the resolution and definition of colors of the user’s computer screen.

Only the visual of Article that appears at the time of the order control must be taken into account by the customer.

In case of errors or omissions in the description of an article, the liability of Anyoine is limited to the reasonable costs of return of the item by the customer.

Anyoine is committed to deliver products meeting current requirements for safety and health of persons in accordance with European requirements, in particular to legislation on regulated chemicals.

The items available for sale are those listed on the website. The offers are valid until they are visible on the website.
The articles proposed are it only within the limit of stocks available as displayed on the website.
Anyoine reserves the right to withdraw from sale at any time any Item on the Site and / or to replace or modify any information associated with the items on this Site.
In case of unavailability of an article after placing the order, the customer is notified by email and the order is automatically canceled.

  1. Products and payment

Placing an order
The customer materializes the order filling the following steps

- The customer selects the items and adds them to the shopping cart after selecting the wanted size.
The shopping cart located at the top right of the screen informs the customer that the selection has been taken into account, indicating the number of products inside.

- The customer checks the contents of the shopping cart by clicking on “order” in order to access the summary of the order (product, size, quantity)
The total amount including VAT is indicated on the summary. It draws a distinction between the price payable for the products and the shipping cost.

- Once the order verified and optionally modified, the Customer confirms his shopping cart in order to finalize the order clicking again on “pay the order”

- If the customer has a promotional code, reserved for the best customers, he will have to write it in the specified area to use it.

Data entry by the Customer of delivery details and billing :
Fields marked with an asterisk (*) are mandatory ; knowing that except specific indications by the customer, the billing address will be automatically the same as the shipping address.
If the customer has already created an account during a previous browsing a on the website, he has a customer account. In this case, he will only identify himself with his e-mail address and his password.
Afterwords, the customer checks all the information and clicks on “confirm” to continue his order.

Order Confirmation
Upon acceptance of customer payment, the customer will receive an order confirmation e-mail. It will summarize all items ordered, the billing and shipping address and the shipping date.
The order validation by the customer and the order confirmation sent by e-mail by Anyoine after the acceptance of the payment is considered as the conclusion of a selling contract between the parties and the acceptance of the General terms and conditions of sale.
The customer who has made the order will be able to print his bill by connecting himself on the Website, in the order tracking area of the website.

Anyoine customer service is at customer disposal for all requests related to his order. The customer service is available by e-mail at the following address : serviceclients@noliju.com from Monday to Friday.

Payment
The customer can pay by credit card or Paypal account directly on the website. The payment by check is not accepted. The customer gives his credit card number associated to the expiration date and the security code. He finally confirms his order. After validating the payment, the customer validates definitively and irrevocably his order. The products are Anyoine property until the full payment of the order.
The price of items purchased is due on the day the order is made by the client. The payment is made online by credit card during the order confirmation by the client.
The application for authorization of the debit is done at the time of the order confirmation on the website, exception made for unavailability of servers.
In the hypothetic case of a payment default, a wrong address or any other issue on the customer account, Anyoine reserves the right to block the order until the resolution of the issue,

Transactions made on the website are secured by Anyoine partner payment system Atos.
All the information shared to treat the payment are encrypted using SSL (Secure Socket Layer). These data cannot be detected, intercepted or used by third parties
and are not transiting on our computer [...]systems either.
Atos verifies that the connection with the client browser is secure before sending the payment form to the bank institute that makes the financial transaction.

Fight against credit card fraud
The information related to your order are subject to automated processing. This automated processing of data intends to define a level of analysis of a transaction and to fight against fraud credit card.

Anyoine is the recipient of the data related to your order. The non-transmission of data related to your order prevents the execution and analysis of your transaction.

The occurrence of unpaid invoices due to fraudulent use of a credit card registration will imply the registration of contact information related to the order associated to this outstanding payment. It will be registered in a payment incident file. An unusual statement or anomaly may also be subject to a specific treatment.

  1. TERMS OF DELIVERY

The customer can chose between several delivery methods at his expense. (see details in the tab “Terms of delivery”)

Thanks to the expedition number, the customer can track his order on the carrier website that have been chosen by the client.

The customer will receive by e-mail an order number confirming the support of the order. He will be informed of each step of the order by e-mail. The ordered items are delivered within 30 days from the order registration, subject to the payment of the full price.
The customer is informed that he has to give all the precisions that can be useful to receive his order properly (access code or other specification).

If the client is absent at the moment of the delivery, a notice will inform him about terms of the conservation of the package and its provision under the entire and exclusive carrier responsibility.

Expeditions are announced by e-mail to the customer, at the e-mail address entered in the customer account.

A delivery note is included in the package, summarizing the ordered items and actually delivered.

If the shipping address entered by the customer is not valid and implies a return of the parcel for non-receipt at the address, the return postage will be to the customer.

The customer assumes entirely and exclusively the risks relating to items from delivery.

Delivery Time:

The order will be sent within 3 days after the order confirmation. Items are delivered at the shipping address indicated during the order. Delivery times for each area are detailed below apart from any fortuitous event or force majeure that would delay the delivery independently of the will and diligences of Anyoine.

France : 3 open days
Europe, USA and Canada: 3-5 open days
Rest of the world : 5 – 10 open days

During the order, please make sure the costs charged to transport your goods. The items will not be returned to us if you have actually validated your purchase and therefore transport costs.

  1. RETURN – CLAIM – RIGHT OF WITHDRAWAL

Right of withdrawal

Customer have 14 days from the order receipt to make a return.
To make a return, the following procedure has to be entirely respected :

The customer will have to join the return note previsouly asked to the customer service : serviceclients@noliju.com (see the tab “Return Procedure” for more information).

The items have to be sent back in their original packaging, with their tag and potential accessories, in a perfect condition of resale. They will therefore neither have been worn, washed or damaged
Return fees are to the customer, delivery fees are reimbursed by Anyoine if the order is sent back in its entirely.

Reimbursement are made on the credit card used for the initial purchase within 30 days from the order return date.
If those conditions are not respected, Anyoine can refuse your return.

The sending back has to be done by mail at Anyoine CEEI, Service des Retours, bureau 3.19, 61-63 Avenur Simone Veil, 06200 Nice.

Return

In case of delivery of an item that doesn’t fit with the customer order, or because of transportation damages, client can send back the item in question after getting a return note from Anyoine by following the procedure below and available on the website.

The reimbursement procedure is exclusive from any product change and this to save the Customer the time and manner of exchange procedures that may present a major drawback for the latter.

The customer can obtain a return note:

If the package is damaged (and in this case, the customer has to refuse the delivery or obtain a certificate of damage by the carrier)
If the item delivered is different from the one ordered on the website.

In those two situations, the Customer must return the nonconforming item for a refund of the price of his order.

To obtain the reimbursement :
The customer has to contact Anyoine customer service, absolutely no later than within 30 days of shipment of his order to obtain return note (
serviceclients@noliju.com)

Any claim made after this deadline won’t be accepted and Anyoine will be relieved of all responsibilities.

If the reimbursement conditions are filled, Anyoine will send a return note valid for 10 days. The customer will join the note to the items return package.

The customer will proceed to return of products that don’t fit within the 10 days of his order receipt.

Any non-compliant return (without any return note) will be rejected. Anyoine will be relieved of all responsibility.

The reimbursement comes only if Anyoine has recovered products previously delivered. Anyoine make the reimbursement using the same payment method used for the transaction, unless the customer expresses a wish to the contrary.

If the delivery location is outside France, the return of products is to the customer. The retour of products is free if the delivery place is in Metropolitan France.

If the customer doesn’t respect the actual General terms and conditions, Anyoine will not proceed to the reimbursement of concerned products. In any case, return fees are to Anyoine if the delivered product is different from the ordered item or if it is delivered damaged.

  1. PERSONAL DATA

Anyoine collects some information necessary to process orders.
These data are necessary to process customer order by Anyoine but also to communicate information on the brand Noliju, on the website or to receive Noliju commercial offers, if the customer accepts it in validating his order.

Information are strictly confidential and are mentioned by an asterisk (*) when they are necessary for Anyoine, and/or their providers for the management of the customer order.

Following any order of local authorities or to defend the society right or those of its employees, clients or any other person, Anyoine will be able to communicate these data to organizations and authorities legally entitled.

Anyoine is committed to take every precaution to assure its files security and the protection of its computer system, and prevent from biased or damaged client private information but also from access by unauthorized party.

The customer private data are sent and stocked at website host in France. The details can be seen on the website “Legal notices”.

In accordance with the French Data Protection and Freedom of Information Law (Loi Informatique et Liberté) of January 6, 1978, as amended by the Act of August 6, 2004, the Customer has the right of access, rectification, modification, and [...]deletion of his data.

The website has been declared to the National Commission on Computer Technology [...]and Freedom (CNIL) as #1956910.

The customer may exercise this right by sending an e-mail precising his name and surname at the following address : serviceclients@noliju.com

The customer can also modify his information from his customer account. He will have to log in using his e-mail address and his password.

  1. COOKIES

In order to treat the customer order and to know more about his needs and to personalize services on the website, Anyoine is using cookies.

A cookie is a data file that is stored on your computer's [...]hard disk in order to report his presence on the website.

A cookie memorize customer’s visiting time on the website, his identity (known thanks to the e-mail address and the password) and his shopping cart content. Once disconnected from the Website, the information are stocked during 30 days before being erased.

The customer can object to the cookie registration configuring his web browser. He loses all the service personalization proposed on the Website.

  1. LIMITATION OF LIABILITY

Placing an order on the website implies the knowledge and the acceptance of current procedures on the Internet network especially concerning technical performances, time of answer, connection, queries or information transfers, risk of web break, the risk of contamination by viruses circulating on the network and in general all the risks associated with the use of the Internet.

Anyoine cannot be responsible for any direct or indirect damage due to a wrong use or any incident related to the use of computer, Internet access, maintenance or malfunctioning servers, telephone line or any other technical connection. The client connection to the website is done under his own responsibility.

  1. FORCE MAJEURE

Anyoine will not be responsible for total or partial non execution of its obligations on the order placed by the customer if this non execution is due to an event constituting a force majeure as it is defined by substantive law.
In such case, Anyoine will inform the customer by e-mail about the event within 3 days after its occurrence.
After one month and if the force majeur event does not stop, the order will be cancelled and reimbursed within 30 days by Anyoine on the credit card used to place the order

  1. APPLICABLE LAW

If any terms of those General terms and conditions of sale are declared null, illegal or unenforceable by court, the other measures from General terms and conditions of sale will remain in force.

The general terms and conditions of sale are executed and interpreted according to the French Law.

In case of claim, the customer will first contact Anyoine to find a friendlly solution and if failing agreement, the Regular court of law will be exclusively competent.

  1. INTELLECTUAL PROPERTY

Anyoine is exclusively property right owner :

On the items available on the website, the brands related to items, on the website and particularly its arborescence, on its organization and titling of the sections, its visual and graphical identity, its design, its usability, its functions, on the software, texts, animated or static picture, sounds, know-how, drawings, graphic design and any other element that makes up the website.

On the data bases, their structure and contents, created and managed by Anyoine for publishing the website.

On every conception elements of the website : graphical, on the names, abbreviations, logos, colours, or other signs that could be used, realized or implemented by Anyloine.

It is therefore prohibited to reproduce in any form, directly or indirectly the elements developed in the previous paragraph. It is also prohibited to alter brands, patents, names, abbreviations, logos, colours, graphical designs and other details on every elements available on the Website, and globally it is prohibited to use or exploit those elements differently from the previous explained usage.

As such, reproduction or use of all or part of these elements is only authorized for information purposes for personal and private use, any reproduction or use of copies for other purposes is expressly prohibited. Any other use without the prior written permission of Anyoine constitutes infringement and is punishable under Intellectual Property.

The creation of hypertext links to the home page of the Site, or any other page of the Site is subject to the prior written consent of Anyoine.

  1. GTC CHANGES

Given the possible evolution of the Site and regulations, Anyoine reserves the right to modify at any time the Terms. The new GTC will, if necessary, reported to the Customer by online modification and will apply only to sales made after the change.
